Marriage Consent

Louisiana law required female minors (under 21) to obtain consent from an older male family member.  In Catharine’s case, she arrived in New Orleans by herself. 

 

Before me, THE UNDERSIGNED, Third Justice of the Peace for the Parish of Orleans, Personally Appeared Jacob Neuhauser, Who in the presence of the undersigned Witnesses, declared to me that he gave his consent to the MARRIAGE of Catharine Margaretha Christina Finke, a Minor, aged 20 years, with Anton Hirlinger.

 

In testimony Whereof, the appearer, he signed this consent together with the Witnesses, and me the said Justice of the Peace, at the CITY OF NEW ORLEANS this 7th day of April 1870.

Marriage Obligation

Hirlinger signed this marriage obligation and pledged a sum of $1,000 to the State of Louisiana should anything appear within two years making this marriage illegal.  Fortunately, Anton and Catharina remained married for many years and avoided having to pay the state this obligation.

 

Be it remembered, that Anton Hirlinger Principal, and Lar Gugenheim, as Surety, acknowledges themselves indebted unto the State of Louisiana, in the sum of one thousand dollars.

 

Whereas, the above bounded Anton Hirlinger has applied to the Undersigned, Third Justice of the Peace for the Parish of Orleans, and has obtained from him a License to marry Catharina Margaretha Christina Finke.

 

Now the Condition of the above Obligation is such, That in case within two years from this date it should not appear that there existed at the time of granting such License, any legal impediment to said Marriage, then and in each case the above Obligation shall be null and void, or else it shall remain in full force and virtue.

 

Done and Signed, at the City of New Orleans, this 7th day of April, 1870.
